What to Do When You Know the Dog's Owner

Many dog bites occur in the homes of friends or family. Many clients, and prospective clients, have indicated a hesitancy to involve a lawyer because of the friendship and/or familial relationship between the injured party and the dog's owner.

While the hesitancy to seek a recovery against a close friend or family member is understandable, an injured person must realize that foregoing a claim against the responsible party may very well leave the injured party in a less than desirous position.

Many clients, or prospective clients, have asked me who pays when a claim is made for a dog attack. The responsible party has the obligation to pay, but in the vast majority of cases, the responsible party will have insurance to cover the loss. When insurance is involved, the responsible party will not have to pay the claim out of pocket and the responsible party is almost never in jeopardy of "losing their home" because of the claim.
