Understanding DWI/CDL Penalties and Consequences
In addition to all of the penalties that noncommercial drivers face in a DWI-related offense, commercial drivers can also face an automatic one-year suspension of a commercial driver's license. Even for a DWAI conviction, a commercial driver can be out of a job for at least a year. In addition, the driver does not have to be operating a commercial vehicle to lose a CDL. If you are driving your family vehicle, unrelated to work, all the same rules apply.
Commercial drivers should be aware of the following standards in New York:
DWAI: Blood Alcohol Content of .04 or higher. One year suspension of CDL.
Second DWI or DWAI: Permanent revocation of CDL. Minimum 10 years before reinstatement.
Third DWI: Permanent revocation without the possibility of reinstatement. Any breath test refusals will also count as violations in the event of a third offense. For example, if you have two DWI offenses and one refusal, you are considered to have three offenses.
