Not guilty verdict after jury trial, Manhattan Supreme Court, on charges that the Defendant intentionally caused serious physical injury to his girlfriend's dog; District Attorney's position was two (2) years in prison; jury found Defendant not guilty

Not guilty verdict after jury trial, Orange County Court, Judge Berry, on Felony DWI charges. The defendant was highly intoxicated, but the District Attorney could not prove he was operating the vehicle; jury found defendant not guilty; deliberations took 12 minutes. The District Attorney was asking for prison time on the rejected plea bargain.

Not guilty verdict after jury trial, Misdemeanor DWI charges, Town of New Windsor Justice Court. Police alleged my client had a .12 blood alcohol count when police pulled her over. I challenged the breathalyzer results and called multiple witnesses to testify to the small amount of alcohol consumed. Jury found defendant not guilty on DWI charges as well as the lesser charge of Driving While Impaired.

Not guilty verdict after trial, Criminal Contempt and related charges stemming from a neighbor dispute, Town of Warwick Justice Court. This jury liked my client so much they wanted to find the complaining neighbors guilty even though they weren't charged.

Not guilty verdict after trial, Assault in the Third Degree, City of Newburgh Justice Court. In this case, my client, a bouncer at a bar/restaurant, was originally charged with felony Assault for breaking a patron's jaw in multiple places and rendering him unconscious for a single punch event. The District Attorney reduced the matter to a misdemeanor for trial purposes, and the jury found my client not guilty on a theory of self-defense. The key to this victory was fantastic investigative work by my investigator, who found evidence and information which proved invaluable during the trial.

Not guilty verdict after trial, Petit Larceny, Town of Newburgh Justice Court. In this case, I represented a 32-year-old professional who was accused of stealing a $20 pair of ear muffs from a department store at the mall. Two (2) security guards testified that they watched my client put the ear muffs in his coat pocket and walk out the door. Store security cameras showed my client at the rack of ear muffs, but there was no indication on the video that my client put the ear muffs in his pocket. The security guards testified that they were 10 feet away and saw him do it off camera. What the security guards did not realize is that at the same exact time that they claimed to be 10 feet away watching my client secrete the ear muffs, another camera caught them both coming back from lunch over 150 feet away. My investigator and I spent hours watching the videos in order to be familiar enough with them to effectively cross examine the security guards.

Not guilty verdict after trial, Assault with a Deadly Weapon (Assault in the Second Degree), Orange County Court. In this case, I was brought in as a trial consultant for another attorney. I assisted in preparation of a defense on a claim that our client shot a man on the sidewalk in the City of Newburgh. The main evidence in the case was a claim by a Detective that our client admitted to him that he shot the victim. The defense focused on the cross-examination of the Detective so that the jury would have a proper perspective when our client took the stand to testify as to what really happened on the street and what really happened in the police station when the Detective claimed the incriminating statements were made.

Not guilty verdict after trial, DWI, Town of Highlands Justice Court. In this case, I was brought in as a trial consultant to assist another attorney prepare for a DWI trial. The issue in this case was intoxication, and the case was won after an aggressive attack on the breathalyzer results on the grounds that the machine was not working properly.
